By accessing or using Polynex AI services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. These terms apply to all users, clients, and others who access or use the service.
2. Description of Services
Polynex AI provides AI-powered voice receptionist services for roofing contractors and related businesses. Our services include automated call handling, lead capture, appointment scheduling, multi-language support, and related features delivered through our platform. Service availability and features may vary by subscription tier.
3. Subscription & Payment
Services are provided on a subscription basis. Fees are billed monthly or annually as selected at signup. All fees are non-refundable except as expressly stated herein. Polynex AI reserves the right to modify pricing with 30 days' written notice. Failure to pay may result in suspension or termination of your account.
4. Client Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must notify us immediately of any unauthorized use of your account.
5. Acceptable Use
You agree not to use the service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the service. Prohibited uses include but are not limited to: harassment, fraud, transmission of malicious code, unauthorized data collection, and any use that violates applicable federal, state, or local laws.
6. AI-Generated Content & Calls
Our AI voice agents interact with your callers on your behalf. You acknowledge that AI-generated responses may not always be perfect and agree to review and configure your agent settings appropriately. Polynex AI is not liable for any miscommunication, missed opportunity, or damages arising from AI-generated call interactions.
7. Call Recording & Data
Calls handled by Polynex AI may be recorded for quality assurance, training, and service improvement purposes. You are responsible for ensuring that all required disclosures and consents are obtained from callers in accordance with applicable wiretapping and recording laws in your jurisdiction. Call data is retained per our Privacy Policy.
8. Intellectual Property
All content, features, and functionality of the Polynex AI platform — including but not limited to software, text, graphics, logos, and audio — are the exclusive property of Polynex AI and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the service solely for your internal business purposes.
9. Confidentiality
Each party agrees to keep confidential all non-public information disclosed by the other party in connection with the services. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law. Confidentiality obligations survive termination of these Terms.
10. Limitation of Liability
To the maximum extent permitted by law, Polynex AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or loss of data — arising out of or related to your use of the service, even if Polynex AI has been advised of the possibility of such damages. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Polynex AI, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
Either party may terminate the service agreement with 30 days' written notice. Polynex AI reserves the right to suspend or terminate your account immediately for material breach of these Terms, non-payment, or conduct that we determine poses a risk to the platform or other users. Upon termination, your right to access the service ceases immediately.
13. Modifications to Terms
Polynex AI reserves the right to modify these Terms at any time. We will provide notice of material changes via email or a prominent notice on our website at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the revised Terms.
14. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
